Privacy Consent Form
Commercial Equipment Finance
This Privacy Consent Form is provided by Lyft Capital Pty Ltd (ABN 18 623 527 775), trading as EquipPay (“EquipPay”, “we”, “us”, “our”), the holder of Australian Credit Licence number 541052. EquipPay is a commercial equipment finance broker. Our services are provided in connection with credit for business or commercial purposes only. We do not assist with consumer credit (credit obtained wholly or predominantly for personal, household, or domestic purposes).
By signing this form, you authorise EquipPay to act on your behalf, and you give specific consent to the collection, use and disclosure of your personal information and credit information for the purposes set out below. Please read this form carefully before signing. A copy of our Privacy Policy is available at equippay.com.au/privacy.html or by contacting us using the details at the end of this form.
PART A — KEY TERMS
1. Definitions
Personal Information
Has the meaning given in the Privacy Act 1988 (Cth) — information or an opinion about an identified individual or an individual who is reasonably identifiable, whether true or not.
Credit Information
Has the meaning given in section 6N of the Privacy Act 1988 (Cth) and includes information about your identification, the type and amount of credit you have applied for or hold, your repayment history, defaults, payment information, court proceedings, personal insolvency, serious credit infringements, and your credit eligibility and creditworthiness.
Credit Reporting Body (CRB)
A body that operates a credit reporting business as defined in the Privacy Act. The CRBs we deal with are set out in section 4.
Credit Provider
A credit provider, lessor, lender, insurer or other finance product provider listed in the Credit Provider Schedule at the end of this form, or otherwise notified to you.
You / Your
Each individual signing this form, whether in your individual capacity as applicant, or as a director, partner, trustee, beneficial owner, guarantor or authorised representative of an applicant entity. Where there is more than one signatory, this form binds each of you separately.
PART B — AUTHORITY TO ACT
2. Authority to act
You appoint EquipPay as your authorised agent to refer, introduce, prepare, submit, negotiate, manage and finalise your application for finance or insurance with one or more Credit Providers. Specifically, you authorise EquipPay to:
- communicate with Credit Providers about the type, amount, structure and terms of finance you are seeking, including any later changes to scope, amount, structure or supporting documentation;
- complete or correct missing information on application forms with information you have provided to us, whether verbally or electronically;
- liaise with your nominated accountant, financial adviser, broker, solicitor, banker, equipment supplier, employer (where applicable for income or business verification), trade references, and any other party you have nominated, to obtain information and supporting documentation in connection with your application;
- receive and provide documents and information on your behalf, including credit assessments, indicative quotes, formal offers and settlement instructions; and
- represent you in relation to status updates and queries from Credit Providers about your application.
You also authorise the parties listed above to provide EquipPay with information and supporting documentation, and to discuss your information with EquipPay and our Credit Providers as reasonably necessary in connection with your application.
This authority does not extend to EquipPay signing acknowledgements, finance contracts, leases, guarantees, mortgages, security agreements or insurance contracts on your behalf, unless you separately and specifically authorise us in writing to do so.
PART C — PRIVACY CONSENTS
3. Information we collect, use and disclose
We will collect, hold, use and disclose your Personal Information and Credit Information for the following purposes:
- to verify your identity (including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)), and to verify the accuracy of information you provide;
- to assess your application for commercial finance and your eligibility, including by considering your creditworthiness and ability to service debt;
- to introduce you to Credit Providers, and to submit, manage and finalise your applications with them;
- to support an application for finance by a business of which you are a director, partner, trustee, beneficial owner or proposed guarantor, and to support a guarantor or co-borrower in connection with your application;
- to comply with our legal and regulatory obligations as the holder of an Australian Credit Licence;
- to provide ongoing customer service, deal with enquiries, complaints, disputes and requests;
- to monitor the performance of any finance you take through us, and to communicate with you about your application or any product you hold;
- to detect, prevent and respond to fraud, security incidents and unlawful activity;
- to communicate with referrers, partners and equipment suppliers in accordance with section 8 below;
- to send you marketing communications, in accordance with section 9 below;
- to improve our products, services and credit assessment processes; and
- for any other purpose required or permitted by law, or with your further consent.
Without your information, we may not be able to provide our services or arrange finance for you.
4. Credit reporting
You consent to EquipPay and our Credit Providers collecting from, retaining, and disclosing to, a Credit Reporting Body your Credit Information, and the Credit Information of any business of which you are a director, partner, trustee or beneficial owner. You consent to EquipPay disclosing your Personal Information (including your name, date of birth and address) to a CRB to obtain a match against the CRB’s records and to obtain a credit report.

Statement of Notifiable Matters
In accordance with paragraph 4.1 of the Privacy (Credit Reporting) Code 2024, we make the following matters known to you:
- You can request a CRB not to use your Credit Information for the purposes of pre-screening direct marketing offers by a credit provider. You can do this by contacting the CRB directly.
- You can request a CRB not to use or disclose your Credit Information if you reasonably believe that you have been or are likely to be a victim of fraud (including identity theft). The CRB must comply with that request.
- You can access the Credit Information that a CRB or we hold about you, and request that it be corrected if it is inaccurate, out-of-date, incomplete, irrelevant or misleading. We will respond to a correction request within the periods required by the CR Code.
- You can obtain a free copy of your credit reporting information from a CRB once every 12 months — or more frequently in certain circumstances, such as following a correction request or where you have been refused credit in the past 90 days.
- CRBs may use your Credit Information to provide credit reporting services to other credit providers in the ordinary course of their business.
- You can complain to us, to a CRB, or to the Office of the Australian Information Commissioner about the handling of your Credit Information. See section 13 for our complaints process.
5. Banking transaction data
To assist with the assessment of your application, we may use an embedded bank statement tool provided by illion to collect and analyse your banking transaction data. You can also choose to provide bank statements manually as an alternative.
Where you use the illion bank statement tool, you consent to EquipPay obtaining, retaining and using your banking transaction data for the following purposes:
- verifying information you have provided about your business and finances;
- preparing applications and supporting documentation for Credit Providers;
- disclosing the data to Credit Providers as part of the credit assessment process;
- monitoring the performance of any finance you take through us; and
- improving our credit assessment processes (in aggregated and de-identified form).
We do not store your bank login credentials. illion’s own privacy policy governs how illion collects, handles and stores your data and is available at illion.com.au. You may withdraw your consent for ongoing banking transaction data access at any time by contacting EquipPay using the details at the end of this form, or by managing your authorisation directly with illion.
6. Disclosure of your information
You consent to EquipPay disclosing your Personal Information and Credit Information to:
- Credit Providers listed in the Credit Provider Schedule (or otherwise notified to you), for the purpose of obtaining quotes, submitting applications, managing settlement, and ongoing servicing;
- any person who is, or proposes to be, a guarantor or co-borrower in connection with your application;
- our aggregator, Fintelligence Pty Ltd (ABN 80 625 017 174, ACL 511803), and through their systems for the purpose of placing your application with Credit Providers and for compliance audits;
- your nominated accountant, financial adviser, broker, solicitor, banker, equipment supplier, employer or other professional adviser;
- identity verification, AML/CTF and fraud prevention service providers;
- valuers, conveyancers, insurers, settlement agents and asset suppliers involved in the transaction;
- our service providers, contractors and consultants (including IT, hosting, communications, document management and call recording providers);
- our auditors, advisers, insurers, related bodies corporate and authorised representatives;
- industry bodies, regulators (including ASIC, AUSTRAC and the OAIC), tribunals, courts, and external dispute resolution bodies (including AFCA);
- debt collection agencies, where applicable;
- any prospective purchaser of our business or assets, subject to confidentiality obligations equivalent to those that apply to us; and
- any person to whom we are required or authorised by law to disclose your information.
We may hold or process your information on servers located outside Australia, including in the United States, in accordance with our Privacy Policy. Where we do, we take reasonable steps under APP 8.1 to ensure that the overseas recipient handles your information consistently with the Australian Privacy Principles.
7. Aggregate and anonymous data
You consent to EquipPay generating and using aggregate, de-identified or anonymised data based on your application, banking, credit and interaction information for any business purpose, including product improvement, model development, industry reports, and data-based market intelligence. Aggregate or anonymised data will not reasonably identify you and will not be disclosed externally in a form that could reasonably identify you.
8. Referrers and equipment suppliers
Where you have been referred to EquipPay by an equipment supplier, accountant, broker, partner or other third party, you consent to EquipPay collecting from, and disclosing to, that referrer your Personal Information and the details and status of your application (including outcomes such as approved, declined, withdrawn or settled). This information is shared solely for the purpose of facilitating your application and the supply or settlement of the financed equipment. It is not shared for the referrer’s own marketing purposes.
9. Direct marketing
You consent to EquipPay using your contact details to send you marketing communications about our products and services and (where relevant) those of our Credit Providers, by email, SMS, telephone, post or other electronic means. Where you have provided your contact details in connection with a business finance application, you confirm those contact details are wholly, primarily or predominantly for business use, for the purposes of the Spam Act 2003 (Cth).
You may opt out of direct marketing at any time by clicking the unsubscribe link in any marketing email, replying STOP to any marketing SMS, or contacting us using the details at the end of this form. Opting out of marketing will not affect your application or any product you hold.
10. Recording of communications
You consent to EquipPay recording and retaining all telephone, video, voice messaging, in-person and other electronic communications relating to your application or any product you hold, for training, quality assurance, dispute resolution and compliance purposes.
11. Electronic communications and signatures
You consent to EquipPay communicating with you, and providing documents to you, through electronic means under the Electronic Transactions Act 1999 (Cth) and corresponding state legislation. You consent to using an electronic signature to execute this form and any other document in our dealings with you, and you acknowledge that this method of signature identifies you and is as reliable as is appropriate in the circumstances.
You are responsible for maintaining appropriate systems to receive, access, review, print and save electronic communications. You may withdraw your consent to electronic communications at any time by contacting us.
12. Duration of consent — commercial credit
Where you are signing this form in connection with an application for commercial credit (credit wholly or predominantly for business purposes), this Privacy Consent remains effective for 12 months from the date of signing. You are not required to sign a new Privacy Consent Form for each application you lodge with us within that 12-month period.
You may withdraw this consent at any time in writing by contacting EquipPay using the details at the end of this form. Withdrawal will not affect anything done in reliance on your consent before withdrawal takes effect.
13. Withdrawal of consent
You may withdraw any consent given in this form at any time by contacting EquipPay using the details at the end of this form. We will tell you what effect withdrawing a consent will have on our ability to continue providing services to you. Withdrawal will not affect anything we have already done in reliance on your consent before the withdrawal.
14. Access, correction and complaints
You may request access to, or correction of, the Personal Information and Credit Information we hold about you by contacting EquipPay. Our Privacy Policy at equippay.com.au/privacy.html explains how we will respond. If you have a complaint about how we have handled your information, please contact us in the first instance. Our Complaints Policy is available at equippay.com.au/complaints. If unresolved, you may refer the matter to AFCA or the OAIC.
15. Acknowledgement of accuracy
You acknowledge that the information you have provided, and will provide, to EquipPay is true, accurate and complete to the best of your knowledge and belief, and that EquipPay and our Credit Providers may rely on it.

By signing below, I confirm that I have read, understood and agreed to this Privacy Consent Form, and I give the consents set out in it. Where there is more than one applicant, director, trustee, beneficial owner or guarantor, each individual must sign their own copy of this form.
